Social justice - red : could you please explain the difference between courts set up for pendency drives and fast track courts?

Fast tracks have been made only to clear the pendency however pendency drives may not necessarily only mean fast track court

Sir along with horizontal extension (more courts) , vertical extension ( efficient and effective courts) could also reduce pendency. What could be possible hurdles in importing efficiency of courts in Indian context? Sir

Judicial reforms have always been sought after. However the term 'fast track court' itself is a paradox Justice cannot be 'targeted' One of the largest litigant in our country is the government 'Simpler laws' can be one of a solution

We discussed the difficulty in getting a decent performance indicator for a 'bureacrat' having one for a judge is atleast 10 times more difficult

so sir, there isn't any defined domain with respect to which they are constituted. because pendency reduction drives have been organized for cases related to marginalized communities ...while the fast track courts have been often set up for issues related to women

fast track courts have been set up for various reasons

fast track courts are clear cut they are made with the fund from the eleventh finance commission funds lot of details available in the net. courts for pendency drives - this includes fast track courts

Sir.... there is a argument that "Justice hurried is justice buried " and "Justice delayed is justice denied " .... how do actually indian judiciary manage this catch 22 situation wrt to fast track courts?

fast track courts do the following

1, more courts

2, more judges - retired ones, ad hoc ones

3, deal with particular type of cases - so efficient

Fast Tract Courts: These are like any other courts. In a court due to high number of cases normally a case is adjourned with huge gaps. Like the hearing in a case comes once in a month. These ftc courts are formed and less number of sensitive cases are assigned to them. So short adjournments make the trial fast. All the procedures are adopted and justice is not hurried. But also no delayed.

There a difference between under trials and ftc courts. Issue of under trails is because of charges getting of cases and sureties. Any person after 90 days can get himself released on bail if chargesheet is not laid except in few laws. Thats a different scenario. Ftc has nothing to do with under trials. This is basically for a speedy trial. Cases are again divided in to simple cases and session cases. Session cases are like murder. Ftc basically deals with session cases.

Sir... in FTC both non-cognisable and Cognisable cases are taken up ?

No, Non cognizable cases are done in lower level.courts

sir, so for undertrials some other court is set up? fast track - for speedy justice and sensitive cases; undertrials courts are different from normal courts?

There is nothing like under trail courts. All courts look after them
